Health and Safety - Duty of Care: The Law
We just not – Health & Safety is a serious issue, morally and legally. You face fines &/or imprisonment if you don’t comply.
Morally – We should always take care of life and property, certainly the vast majority of us do so automatically without thought. Unfortunately there is sometimes a gap between what we intend and what we do. Hence we have legislation in the UK that stipulates the minimum we must do.
Legally – We believe that there are four sources of law that concern you and your property relating to roller shutters and other automated doors. They are ‘The Workplace (Health, Safety and Welfare) Regulations 1992’ ‘The Regulatory Reform (Fire Safety) Order 2005 and more generally a duty of care that extends into the civil tort of negligence and the criminal law so far as recklessness causing injury & death. Very simplistically if you are at all responsible for a property you have a responsibility to ensure that it is safe.
Legal Advice – We are not lawyers but believe from years of experience that this is true. We have detailed below some of the points of law that you should consider. We strongly advise you to seek professional legal advice if you are in any doubt as to your obligations.
What must I do? – You must always ensure that your shutters & doors are properly fitted, properly maintained, and keep full and proper records.
How do I do it? – We can help you comply with your obligations by regularly inspecting, servicing & repairing as necessary your roller shutters and other doors. We will then supply you with a certificate and written report for you to keep on file. This would become evidence of your efforts to comply with the law and exercise your duty of care.
Is that it? – No – Beyond our inspections and works, you must still operate tests on a regular basis and ensure that faults are rectified immediately. We can help you put a system into place and always offer our free advice.
